Appellant plead nolo contendere to a charge of securities fraud in violation of Section 29.C. of the Texas Securities Act. TEX. REV. CIV. STAT. ANN. art. 581 (Supp. 1991) ("TSA"). The trial court sentenced her to ten years imprisonment, the execution of the sentence was suspended and appellant was placed on ten years probation, conditioned upon the payment of restitution. The Third Court of Appeals affirmed. Martin v. State, 806 S.W.2d 237 (Tex. App.--Austin 1991). We granted appellants petition for discretionary review to settle a conflict among the courts of appeals as to whether restitution may be awarded to victims of crimes for which the defendant has not been charged and convicted. TEX. R. APP. P. 200(c)(1).
