Contributory negligence of the 12-year-8-month-old son of plaintiff, struck dead shortly before nine o'clock in the evening of December 19, 1942, by an automobile of defendant driven by his 20-year-old son, with the father's permission, the evening being snowy and blustery, the car being driven at a speed of 30 to 35 miles per hour on a slight downgrade and along a gentle curve opposite the entrance to a park on the west side of trunk highway No. 29 half a mile north of Alexandria, this state, was a jury issue.
